DOSSCHE MILLS TERMS OF USE

Article 1. General

1.1. This website (hereinafter referred to as the "Website") has been developed and is managed by Dossche Mills NV, with registered office at Clemence Dosschestraat 1, 9800 Deinze, Belgium, registered in the Crossroads Bank for Enterprises under company number 0400.771.039 (hereinafter referred to as "Dossche Mills").

1.2. These terms of use (hereinafter referred to as the "Terms") apply to all use of the Website. Dossche Mills may amend these Terms at any time and publish the revised version on the Website without prior notice. By using the Website, the user (hereinafter referred to as the "User") acknowledges that they have read and agree to the most recent version of the Terms.

Article 2. Purpose and content of the Website

2.1. The purpose of the Website is to provide information about Dossche Mills, its products, services and activities.

2.2.Although Dossche Mills makes every effort to provide accurate and current information, it cannot guarantee that the Website will always be complete, correct or up-to-date. The content of the Website is provided for information purposes only and may be changed, supplemented or removed at any time without prior notice.

2.3. These Terms do not in any way affect the general terms and conditions of sale of Dossche Mills, of which they form an integral part. By using the Website, the User also accepts our general terms and conditions of sale.

Article 3. Intellectual property rights

3.1. All elements of the Website, including but not limited to texts, photographs, logos, trademarks, trade names, domain names, databases, software and graphic elements, are protected by intellectual property rights and are the exclusive property of Dossche Mills.

3.2. Without the prior written consent of Dossche Mills, it is prohibited to store (other than as necessary for viewing the Website), reproduce, distribute, modify, publicly communicate, sell, transfer, or grant any rights in respect of any information or material from the Website to third parties.

Article 4. Permitted and prohibited use of the Website

4.1. The User agrees to use the Website solely for legitimate and personal purposes. It is prohibited to:

  • use the Website for unlawful or harmful purposes;

  • distribute viruses, malware or other harmful files via the Website;

  • disrupt, alter, interrupt or terminate the proper functioning and security of the Website;

  • infringe the intellectual property rights of Dossche Mills or third parties;

  • post content on the Website for commercial or advertising purposes without the prior written consent of Dossche Mills.

4.2. If the User breaches the obligations set out in Article 4.1, Dossche Mills may take any appropriate measures, including denying access to the Website and claiming compensation for damages.

Article 5. Liability

5.1. Under no circumstances shall Dossche Mills be held liable, whether directly or indirectly, generally or specifically, for any direct or indirect damage arising from the use of the Website. This includes, but is not limited to, damage resulting from incorrect or incomplete information, loss or corruption of data on the User's device, or any financial or commercial loss.

5.2. Despite continuous efforts to maintain the Website's security and reliability, internet services can never be entirely free from security risks. Consequently, Dossche Mills cannot be held liable for breaches of the confidentiality of user data resulting from attacks or unauthorised access by third parties to the Website, Dossche Mills's servers, or communications between the Website and those servers.

5.3. Dossche Mills gives no guarantees regarding the proper or uninterrupted functioning of the Website. It cannot therefore be held liable for technical failures, temporary unavailability of the Website, or any damage – direct or indirect – resulting from access to or use of the Website.

5.4. This exclusion of liability does not affect any mandatory statutory provisions that impose a different arrangement.

Dossche Mills has no control over such external resources and is therefore not responsible for their content, quality or accuracy. The inclusion of such links does not imply approval or collaboration. Use of these external websites is entirely at the User's own risk.

The processing of personal data via the Website is carried out in accordance with Dossche Mills's Privacy Statement and Cookie Policy, as published on the Website. Dossche Mills advises each User to read these documents carefully, as they contain essential information about how Dossche Mills collects, processes and protects personal data.

Article 8. Invalidity of provisions

8.1. If a court or other competent authority determines that any provision of these Terms is invalid, unenforceable or unlawful, this shall not affect the validity and enforceability of the remaining provisions.

8.2. The invalid, unenforceable or unlawful provision shall be replaced by a valid and enforceable provision that, to the extent possible, most closely reflects the original intent of Dossche Mills and the User.

Article 9. Waiver of rights

Failure by Dossche Mills to exercise any right or provision arising from these Terms shall in no way be construed as a waiver of such right or provision, nor as a waiver of the right to enforce it at a later time.

Article 10. Applicable law and jurisdiction

10.1. These Terms, as well as any use of the Website, are governed exclusively by Belgian law.

10.2. In the event of any dispute relating to these Terms, the courts of the judicial district of Ghent shall have exclusive jurisdiction.
